Scope
These terms apply between Christian Hählen, Ahornistrasse 16, 3627 Heimberg, Switzerland, as the provider of Loya, and the business using Loya. They are accepted when a business is created.
Loya is appointment booking and customer management software for businesses. It is provided over the internet; no installation is required.
These terms do not govern the relationship between a business and its customers. Anyone booking an appointment through a booking portal enters into that contract with the business, not with Loya. The business’s own terms apply to appointments, prices, cancellations and no-shows. Loya provides only the technical platform.
Trial and fees
- Every new business starts with a five-day free trial.
- After the trial ends, the backoffice remains accessible, but the public booking portal is paused until a subscription is active.
- Existing data is always retained and is not lost when the trial ends.
- Swiss plan: CHF 45 per month for the first business, CHF 35 for the second and CHF 25 for each additional business.
- Thailand plan for approved businesses located in Thailand: 590 baht per month for the first business, 490 baht for the second and 390 baht for each additional business.
- The pricing tiers apply per owner account, separately for each pricing region and in order of business creation. Only approved businesses count towards the Thailand plan tiers.
- Billing is monthly in advance. The subscription can be cancelled at the end of the paid month; there is no minimum term or setup fee.
- Loya charges no commission on bookings or revenue.
- Fachbyte is currently not registered for Swiss VAT and does not charge Swiss VAT. This does not affect any tax obligations the business has in its own country.
- Billing is monthly through Stripe. Selecting “Activate subscription” starts the paid month immediately and ends any remaining free trial.
- If renewal fails, the paid period is not extended. Following a previously paid month, portal access remains open for a 14-day grace period from its end while the subscription is overdue. The portal is then paused; the backoffice and data remain accessible.
- If the current subscription month is fully refunded, the subscription ends and paid portal access is withdrawn. A partial refund or a refund for an earlier subscription month does not change current access.
Thailand plan and location verification
The free trial is available from any country without a credit card. The Thailand plan requires an actual business location in Thailand and approval. Selecting a language alone does not qualify you for the Thailand plan.
Approval is automatic when the registration IP is Thai and the full Thai business address has been provided. For a foreign or unknown registration IP, Loya reviews the location before a paid subscription can start. Contact hello@fachbyte.com if your location has been identified incorrectly.
If a review due to a foreign or unknown registration IP is still pending shortly before the trial ends, the trial is extended once by five days. This does not start a paid subscription.
Approval may be refused or withdrawn if the location details are incorrect. An existing subscription then ends at the end of the paid period; this does not trigger an automatic refund.
If your business is registered for VAT in Thailand, send its Thai tax ID to hello@fachbyte.com. Such businesses must remit Thai VAT on the service received from abroad under the reverse charge mechanism. Fachbyte invoices are not Thai VAT tax invoices.
If applicable law requires your business to withhold and remit tax from a payment to Fachbyte, your business must meet that obligation and provide Fachbyte with the official certificate. Please notify hello@fachbyte.com before payment if withholding is required so that we can agree on how to handle the payment. This clause does not create any tax obligation beyond what the law requires or transfer Fachbyte’s own tax obligations to your business.
Who owns the data
Data recorded by the business — customers, appointments, services and revenue — belongs to the business. Loya processes it solely on the business’s behalf and does not use it for its own purposes.
The business can delete its data at any time. The process is described in the privacy policy.
Data processing on behalf of the business
The business is the controller of customer data, and Loya is the processor. By accepting these terms, the business instructs Loya to process this data to operate the software. Loya agrees to:
- Process the data only to operate Loya and only on the business’s instructions.
- Take appropriate technical safeguards, as described in the privacy policy.
- Use additional processors only if they are subject to the same obligations. The database, server and email providers used are named in the privacy policy.
- Support the business when a customer requests access, correction or deletion.
- Notify the business without delay if data has been disclosed without authorisation.
- Delete the data after termination, within the periods stated in the privacy policy.
Access by Loya administrators
To help resolve problems, Loya administrators may open and work in a backoffice. Such access is clearly visible in the backoffice while active, ends after no more than six hours and is logged.
Business responsibilities
- Do not share login credentials, and revoke access for people who leave the business.
- Only collect data for which there is a lawful basis, and inform your customers about its processing.
- Do not use Loya for unlawful purposes.
Availability
Loya is operated with care, but no specific level of availability is guaranteed. Maintenance is announced where possible. Loya cannot be held responsible for outages caused by server, database or email providers.
Liability
Loya is liable for damage caused by intent or gross negligence. Otherwise, liability is excluded to the extent permitted by law. There is no liability for lost profit or consequential damage.
Cancellation
The business can cancel its subscription in the backoffice under Settings — Subscription and invoices — Manage invoices and payment method. Cancellation takes effect at the end of the paid month; paid portal access continues until then. Deleting the business is not necessary.
A request to delete a business also cancels the subscription at the end of the paid period. Withdrawing the deletion request does not undo the subscription cancellation; it can be reversed in subscription management.
Loya may terminate with 30 days’ notice, or immediately in the event of a serious breach of these terms.
Applicable law
Swiss law applies. The place of jurisdiction is 3627 Heimberg, unless mandatory law requires otherwise.
Changes
Businesses will be notified of changes to these terms by email at least 30 days in advance. Those who do not object accept the changes. Last updated: 24 September 2026.
